1. What Are SESTA and FOSTA?
SESTA (Stop Enabling Sex Traffickers Act) and FOSTA (Allow States and Victims to Fight Online Sex Trafficking Act) are United States federal laws enacted in 2018. They increase the legal liability of websites that facilitate or promote sex trafficking.
2. Our Position
www.seksdayting.com is a Dutch-operated advertising platform that does not facilitate, mediate, or promote sexual acts. Our platform provides advertising space for legal services only. While we are not a US company, we take SESTA/FOSTA principles seriously as part of our international compliance commitment.
3. Measures We Take
In alignment with the intent of SESTA/FOSTA, we implement the following measures:
- Zero tolerance for advertisements that promote human trafficking or forced sex work
- Active moderation and reporting systems for suspicious advertisements
- Full cooperation with law enforcement in investigations into human trafficking
- Clear separation between our platform and the content/execution of advertised services
- Prohibition of any content that could facilitate sex trafficking
4. Jurisdiction-Specific Laws
The legal status of sex work, escort services, and adult advertising varies significantly by country and US state. Advertisers are solely responsible for compliance with the laws of their jurisdiction. We block access from jurisdictions where such advertising is prohibited.
5. UK Online Safety Act (OSA) 2023
To the extent the UK Online Safety Act applies to our platform (due to UK user access), we implement age assurance measures and illegal content risk mitigation in accordance with Ofcom guidance. We cooperate with Ofcom requests as required by law.
6. French SREN Law & EU DSA
France’s SREN Law (Act No. 2024-449) requires age verification for platforms offering adult content accessible from France. We implement geo-based access restrictions for France and other jurisdictions with mandatory age verification requirements. Our practices are aligned with EU Digital Services Act (DSA) obligations.
7. Limitation of Liability
Seksdayting.com accepts no liability for advertisements that violate SESTA, FOSTA, or any other national sex work legislation. Advertisers are solely responsible for compliance with all applicable laws.
